Abstract

The paper analyses whether the Serbian public institutions are sufficiently capable to enforce the EU environmental standards and to protect biodiversity effectively. The author begins the testing of hypothesis by examining the externalities that undermineeffective policy implementation: environmental crime, poor environmental expertise of public institutions, and general lack of environmental awareness.The analysis of the process of implementation of environmental policy focuses on the structural deficiencies of the primary and secondary legislation, the inadequate public appointments on environmental policy, and performance of environmental inspectors, law enforcement agencies, and judiciary in charge of protecting wildlife species. The author concludes that the case of poor protection of biodiversity in Serbia has been an example of how both the lack of political will and weak administrative capacity threaten the effective implementation of public policies as well as the accession process itself.
