Abstract

The evolutionary changes of the International law in the aftermath of the Second World War, took place in the counterpoint of the interests of the great powers and of the less powerful part of the world, which sought to preserve the general values of humanity. Adjusting International law with these contradictions proves the dialectic of its development, which is fundamental to understanding processes and phenomena that determine its existence in the 21st century. The development of International law in the new epoch goes hand in hand with the globalization of international relations. Regardless of the extent to which International law was fragmentary and contradictory to reality, its role was not called into question, since International law is the foundation of the World Order. Although the importance of voluntaristic factors in its development is dominant, the intensive application of International law through international institutions, and especially through international justice, has immeasurable significance. In this regard, the importance of the International Court of Justice as the highest judicial instance in the United Nations system has remained enormous and its role in the peaceful settlement of disputes between states can not be denied, since this Court has certainly contributed to the correct application of International law and its harmonization with the contemporary tendencies in international relations. The work of the International Court of Justice over the past seven decades has raised a professional threshold in clarifying the essence and scope of applicable international law, as well as in revealing its deficiencies that have been successfully resolved through the codification and progressive development process. Finally, the systemic legal practice of the International Court of Justice has influenced the successive strengthening of the international community’s trust in International law and the international judiciary, despite the strengthening of the quasi-judicial and quasi-legislative functions of the United Nations political organs.
